Legislation on ‘Women and Family’ in Pakistan: Trends and Approaches

Abstract

[Constitution of Pakistan holds dignity of every individual inviolable and guarantees equality of all citizens before law. It requires the state to take steps for protection of the marriage, the family, the mother and the child. In pursuance of these fundamental principles and in consideration of woes of women, legislature is expected to take positive action for protection of women and children. During past twenty-seven months (March 2008 to June 2010), Pakistani legislators have come forward with various draft laws relating to the institution of family. This article discusses proposed legislation dealing with issues such as Marriage during Subsistence of Existing Wedlock, Marriage by Concealment, Prohibition of Forced Marriages, Prohibition of ‘Marriage’ with Holy Quran and Child Marriage Restraint. – Eds]
